THE RUFESCENT MEMBERS APP

1. Introduction

The Rufescent Members App (“the App”) is a digital platform operated solely by Dynasoft Applied Systems, DIFC Dubai (“Dynasoft”, “we”, “our”).
The App enables members of The Rufescent (“Venue Operator”) to access digital services including reservations, concierge requests, chauffeur and valet coordination, lounge access management, events, and the Zen Coin (“ZC”) internal rewards and payment system.
Dynasoft provides technology infrastructure only.
All hospitality services, onsite experiences, staff interactions, facilities, pricing, and service delivery are the responsibility of The Rufescent, an independent operator.

By accessing the App, you agree to be bound by these Terms.

2. Membership Eligibility

  • The App is accessible exclusively to active members of The Rufescent.

  • Membership approval is conducted entirely outside the App by The Rufescent.

  • Dynasoft does not manage, verify or decide eligibility, membership criteria, or renewal.

  • Credentials are issued after successful enrollment by The Rufescent’s membership team.

  • Profile details within the App are not required to match the official membership records; Dynasoft does not validate profile accuracy.

3. Services Available in the App

3.1 Bookings

  • Members may use the App to book:

  • Restaurants

  • Bars

  • Lounges

  • Private dining

  • Spa & wellness services

  • Events & experiences

  • Chauffeur transport

  • Valet collection & retrieval

  • Room & stay reservations (where applicable)

3.2 Concierge & Support

In-app concierge allows for real-time service requests and communication.

3.3 Zen Coin (ZC)

  • ZC is a closed-loop digital rewards currency enabling:

  • Purchase with AED

  • Discounts when used for payment (subject to change)

  • Redemption for:

  • F&B

  • Lounges

  • Spa

  • Chauffeur & valet

  • Events

  • Rooms

  • Staff tips

3.4 Arrival & Distance Tracking

  • Location data is used for:

  • Chauffeur dispatch

  • Valet readiness

  • Lounge/venue preparation

  • Entry coordination

3.5 AI-Enhanced Personalization

Dynasoft uses machine learning systems to personalize recommendations and improve the member experience.

4. Booking Availability Guarantee

  • Dynasoft operates The Rufescent’s technical infrastructure and therefore:

  • Availability displayed in the App reflects real-time system accuracy.

  • The Rufescent remains solely responsible for actual service delivery, staffing, quality, and venue operations.

  • Technical accuracy does not guarantee operational performance.

5. Payments

Payments within the App are handled via:

  • Stripe

  • Network International

  • ZC internal spending

  • Any additional approved payment gateway
     

Important:

  • Payments go directly to The Rufescent’s merchant accounts.

  • Dynasoft does not receive, store, or control user payments.

  • All pricing, taxes, tips, charges, and billing disputes are between you and The Rufescent.

Dynasoft acts only as a technical facilitator.

6. Refunds

  • Refund requests may be submitted through the App for convenience.

  • Refund decisions and issuance are entirely controlled by The Rufescent.

  • Dynasoft only processes refunds in cases of verifiable technical processing errors (e.g., duplicate payment).

  • All other refund timelines and rules follow The Rufescent’s policies.

7. Zen Coin (ZC)

  • ZC is a digitally issued, closed-loop spending currency maintained by Dynasoft.

7.1 What ZC Is Today

  • ZC is:

  • A digital loyalty currency

  • Redeemable only within The Rufescent ecosystem

  • Purchasable using AED

  • Usable for all eligible onsite services

  • Non-transferable outside The Rufescent
     

  • ZC is not:

  • A financial instrument

  • An investment product

  • A cryptocurrency

  • Legal tender

  • A tradable asset

  • Redeemable into cash by members
     

  • Guaranteed to retain value

7.2 Staff Redemption of ZC

Staff may redeem ZC for AED as part of:

  • Gratuity payments

  • Performance incentives

  • Internal rewards

  • Bonus programs
     

This conversion:

  • Is provided and funded by The Rufescent, not Dynasoft

  • Is treated as staff compensation, not public redemption

7.3 No Speculation or Trading

Users must not:

  • Trade ZC outside the App

  • Attempt to use ZC as financial speculation

  • Treat ZC as an investment
     

Any such attempts may lead to account suspension.

7.4 Future Stablecoin Evolution

Dynasoft is actively exploring regulatory processes to evolve ZC into a regulated stablecoin.

You acknowledge and agree that:

  • Current ZC holds no financial rights

  • Upon regulatory approval, ZC balances may convert into a regulated form

  • Conversion ratio and rights will be governed at that time

No guarantee of future financial value is provided.

8. User Conduct

Users must:

  • Treat staff and other members respectfully

  • Not misuse booking, chauffeur, valet or ZC systems

  • Not engage in harassment, fraud, manipulation, or abuse

  • Follow all onsite rules set by The Rufescent, including any tier specific restrictions applicable to Blue Lotus members .

The Rufescent may discipline onsite behaviour.
Dynasoft may revoke or suspend access for platform misuse.

9. Scheduled Maintenance

The App may undergo scheduled downtime coordinated between Dynasoft and The Rufescent.

Dynasoft provides enterprise-grade availability outside these windows.

10. Prohibited Activities

  • Users must not:

  • Reverse engineer the App

  • Attempt unauthorized access

  • Circumvent booking rules

  • Manipulate ZC balances

  • Interfere with system integrity

  • Upload harmful content or scripts

  • Any violation may result in account suspension.

11. No Warranty

  • Dynasoft provides a high-reliability, enterprise-grade platform, but:

  • Certain features may be temporarily unavailable during upgrades

  • Data accuracy depends on third-party systems

  • The App is provided on an “as available” basis

12. Limitation of Liability

To the maximum extent permitted by DIFC law:

  • Dynasoft is not liable for any indirect, incidental, or consequential damages

  • Dynasoft’s total liability is capped at AED 1,000 or the amount paid to Dynasoft in the preceding 12 months (whichever is lower)

  • Dynasoft is not responsible for:

    • Onsite services

    • Venue operations

    • Staff behaviour

    • Safety and hospitality quality

    • Member interactions

13. Third-Party Services

Stripe, Network International, and other integrated providers operate independently.
Dynasoft is not responsible for their availability, performance, or errors.

14. Modifications to Terms

Dynasoft may update these Terms from time to time.
Material changes will be communicated within the App.

Continued use constitutes acceptance.

15. Termination

  • The Rufescent may terminate membership, revoking App access.

  • Dynasoft may suspend or terminate App access for misuse, security breach, or fraud.

16. Force Majeure

Dynasoft is not responsible for failures caused by events beyond reasonable control, including but not limited to:
power outages, hosting disruptions, cyber incidents, natural disasters, regulatory orders, or force majeure events.

17. Severability

If any clause is found invalid, the remainder of the Terms remain fully enforceable.

18. Governing Law

These Terms are governed by DIFC law.
Disputes shall be resolved exclusively by the DIFC Courts.
